Abstract
[Machine translation] The textual protoforms brought into focus by Vico in Universal Law (in accordance with Heinrich Lausberg's definition, further elaborated by Franco Brioschi) are analyzed as primitive discourses of re-use (in accordance with the definition of Heinrich Lausberg, further elaborated by Franco Brioschi). We focus in particular on the notion in ancient Roman law of fictio iuris, which Vico uses to explain the mythopoiesis of the first peoples. The notion is deepened in the light of its development in the philosophy of modern law and its ontogenetic and phylogenetic role in rhetorical-imaginative activity./We analyze, as primitive discourses of re-use, (as defined by Heinrich Lausberg, and then elaborated by Franco Brioschi) the textual proto-forms focused by Vico in the Universal right (formula, exemplum, oratio, fiction). We reflect in particular on the notion, deriving from the ancient Roman right, of legal fiction (fictio iuris) which Vico uses to explain the mythopoiesis of the first peoples. We explore the notion in the light of its development in modern philosophy of law and its phylogenetic and ontogenetic role in the rhetorical imaginative activity.
