Abstract
[Machine translation] The “social outbreak” that shook Chile in October 2019 gave way to an intense cycle of mobilizations, which finally crystallized into a constituent process with an uncertain future. In the first stage of this process, a democratically elected Constitutional Convention proposed a progressive Constitution with clearly socio-ecological overtones. This draft was rejected in a plebiscite in 2022. However, it is a text rich in conceptual and regulatory contributions that is worth analyzing. In this article, we will focus on unraveling the philosophical foundations that underpinned this proposal, with regard to the most innovative transformations related to the legal framework of the relationship between human beings and non-human nature: natural common goods and the right to interrelation. From there, we will draw theoretical considerations, in order to highlight the virtues of the proposal as a mirror of the socio-ecological needs manifested in an exceptionally participatory constitutional process.
