Abstract

[Machine translation] Some scholars consider that the current crisis situation resulting from the pandemic does not allow the drafting (and therefore the certification) of a restructuring plan. Others have written that the absolute peculiarity of the Covid-19 crisis, which is a crisis of a nature not only financial, but also economic, consists in the circumstance that it is not possible to plan in precise terms the path aimed at restructuring, nor is it equally possible to predict, with reasonable probability, the prospective future scenarios, so the traditional institutions of the preventive arrangement (and also of the extraordinary administration) appear inadequate to provide the way out. The problem detected lies, not so much in the certification techniques, but in the changed characteristics of the plan subject to their application., Attention must therefore first be given to the methods of constructing and drafting the plans in the new scenario and then only then be re-focused on the methods of attesting the same that, in fact, come from the first.
