N2 - Il contributo intende ricostruire il pensiero e l'opera di Raul Alberto Frosali, attraverso un'analisi degli scritti di questo importante autore fiorentino, autorevole esponente della c.d. Scuola, positiva italiana. I rapporti fra il positivismo criminologico, uno dei prodotti culturali più importanti che si sia irradiato dalla cultura giuridica italiana nel mondo, e l'ideologia fascista sono sempre stati controversi e molto discussi. E' innegabile che il positivismo si presti ad una notevole plasticità, soprattutto perchè il paternalismo fascista molto bene si sposava con il positivismo. Non è vero il contrario, e cioè che il positivismo si potesse adattare pienamente all'ideologia totalitarista nè tantomeno con la successiva ideologia razzista propugnata dal nazionalsocialismo e dal nazisfascismo. Dalla documentazione esaminata, nonchè dai carteggi tra il Frosali e Giorgio Del Vecchio, emerge un profondo spirito di collaborazione scientifica tra fascisti e socialisti, fra italiani istraeliti fasciti e anti-fascisti e italiani non israeliti. La storia scritta dopo la seconda guerra mondiale e dopo la tragedia dell'olocausto ha completamente oscurato il fatto che molti italiani israeliti erano fascisti integerrimi e, fra questi, molti erano scienziati di primo piano, alla cui esauturazione a seguito delle leggi razziali molti colleghi fascisti e non fascisti reagiorono autoescludendosi dal dibattito scientifico, scegliendo una sorta di esilio pubblicistico. La storia successiva ebbe a tacciare questi giuristi positivi di razzismo per il frequente richiamo al concetto di razza. Ad una lettura più serena dei lavori di questi Autori, ci si rende conto che il c.d. razzismo spirituale fosse l'unico criterio al quale si ispiravano, rispetto al sempre ripudiato razzismo biologico. L'esaltazione della razza italica era un riferimento all'estro e alle caratteristiche tipiche della società italiana, ma non aveva scopi di prevaricazione nei confronti di altre popolazioni.
The paper intends to reconstruct the thought and work of Raul Alberto Frosali, through an analysis of the writings of this important Florentine author, an authoritative exponent of the so-called Italian positive school. The relations between criminological positivism, one of the most important cultural products that has radiated from Italian legal culture throughout the world, and fascist ideology have always been controversial and much debated. It is undeniable that positivism lends itself to considerable plasticity, especially since Fascist paternalism went very well with positivism. The opposite is not true, i.e. that positivism could fully fit with totalitarian ideology, nor with the later racist ideology advocated by national socialism and nazisfascism. From the documentation examined, as well as from the correspondence between Frosali and Giorgio Del Vecchio, a profound spirit of scientific collaboration emerges between fascists and socialists, between fascist and anti-fascist Israelite Italians and non-Israelite Italians. The history written after the Second World War and after the tragedy of the holocaust has completely obscured the fact that many Italian Israelites were upright Fascists and, among them, many were leading scientists, to whose extermination following the racial laws many Fascist and non-Fascist colleagues reacted by excluding themselves from scientific debate, choosing a kind of publicist exile. Later history came to brand these positive jurists with racism for their frequent reference to the concept of race. On a more serene reading of the works of these authors, one realises that the so-called spiritual racism was the only criterion by which they were inspired, as opposed to the always repudiated biological racism. The exaltation of the Italic race was a reference to the flair and typical characteristics of Italian society, but had no aim of prevarication against other populations.
