[Machine translation] The work concerns the problem of so-called culturally oriented crimes in the Italian legal system and in that of Western countries that are most affected by multiculturalism. After having addressed the essential issue of the relevance of cultural affiliation in supranational sources and in the jurisprudence of the Court of Justice, the de jure condito and de lege ferenda solutions developed by the criminal doctrine, as well as the most important jurisprudential pronouncements, are examined. At the end of the reflection, an original political-criminal proposal is formulated that makes use of restorative justice, creating moments of complementarity between the punitive and restorative systems.
