Abstract

[Machine translation] What do we mean by de facto society (reality present even before the notion of a company contract was codified) and de facto supersociety (conceived, on the other hand, in vitro)? What is the discrimination compared to other figures with which it is often associated? What is the logical-legal basis for being able to proceed with its judicial liquidation (corresponding to the repealed bankruptcy procedure) “in extension” and then to that “in repercussion” of its institutionally (and not occasionally) unlimited responsible partners? What are the advantages and disadvantages of not formalizing the corporate relationship? , We will try to give an answer to these and other questions, trying to shed some clarity on a subject as fascinating as it is complex, but of extreme practical importance.
