Abstract
[Machine translation] In this study, the author undertakes to reconstruct the constitutional foundations of ius existentiae: the right to be guaranteed a free and dignified life, even when one is in a condition of poverty and unemployment. In particular, the question that is posed at the center of the analysis is whether, when the promise of “work for everyone” is lacking, the Republic has the duty to guarantee everyone, otherwise, existence. The systematic reading of the constitution, illuminated by the original intention of the constituents, leads the author to give a certainly positive answer and to consider citizenship income - in the form of guaranteed minimum income - a constitutionally necessary tool for the creation of a truly emancipating democracy.
