Abstract
[Machine translation] The article addresses the issue of the implementation of the social security function — typical of life insurance contracts — by unit and index linked policies. The reflection is conducted along two different lines that represent the main arguments used by doctrine and jurisprudence to identify the insurance nature of the contracts in question: the guarantee of return of the paid-up capital or the impact of demographic risk on the determination of the quantum of the obligation borne by the insurer.
