Abstract
[Machine translation] The contribution intends to provide a reflection on the changes introduced with the new Procurement Code (Legislative Decree no. 36/2023), with reference to the qualification system of contracting agencies, and an assessment of the compliance of political choices with the effective pursuit of the objective of ensuring that contracting agencies and central purchasing bodies are able to ensure the assignment of the contract and its execution with timeliness and efficiency, as well as respect for the principles of legality, transparency and competition, without prejudice to small and medium-sized enterprises and create unjustified centralizations of power in the hands of certain economic operators or even unjustifiable limits to free economic initiative.
