Abstract
[Machine translation] The chapter consists of three sections. The first describes the general principles of donation, through the recognition of the historical-classifying profiles of the figure starting from his Romanesque roots. The following is the illustration of the discipline provided for in the Italian civil code of 1865, the analysis of the French influence on it and the comparison with the definition of the institution contained in the current Italian civil code. Of this last definition, in particular, the underlying legislative policy choices are investigated. The elements of gratitude and liberality are also examined, noting their controversial reciprocal relationship. The second section explains in more detail the structural requirements of the donation in the current legal system. The third section introduces the topic of contractual parties.
