Abstract

[Machine translation] The reform of the crime of office abuse with Legislative Decree 76/2020, in an attempt to restrict the scope of application of art. 323 of the Italian Civil Code and to give greater strictness to the incrimination, has excluded discretion from the hypotheses unionable by the criminal judge and, therefore, removed excess power from the founding elements of a criminal charge. Through a historical-dogmatic reconstruction of the crimes of 'abuse', the author affirms that there is no power without discretion (technical or constrained). The exclusion of discretion from judicial review seems unrealistic in view of the complexity of the administrative procedure, which requires balancing interests to arrive at a reasonable final solution capable of satisfying the public interest.
