Abstract

[Machine translation] The volume analyzes land ownership rights from an ecological perspective, highlighting the interdependence of people, nature and environment. The objective is to overcome the self-referential conception of civil law, adopting an interdisciplinary approach, which integrates legal and scientific expertise. In particular, it is necessary to rethink the attributes of property and minor real rights, interpreting them as tools of responsibility, oriented to the protection of the territory and ecosystems. In this context, ownership is redefined as an “acquired responsibility”: an institution that is no longer exclusively divisive, but capable of reflecting ecosystem connectivity and promoting the common good. Civil law, therefore, assumes a central role in directing owners to virtuous and sustainable behavior, reinforcing an “eco-social morality” in land management, with the aim of effectively dealing with the challenges of the climate and environmental crisis.
