Abstract
[Machine translation] Starting from the debate that involved the compensattio lucri cum damno, the article imagines a dialogue with the doctrine that inspired the solution most recently accepted by the jurisprudence of the Court of Cassation on the subject. In this perspective, we wonder in particular about the coherence of compensattio lucri cum damno with respect to the multifunctionality of civil liability, as well as its applicability to non-pecuniary damages.
