Abstract

[Machine translation] The Euro-unitary approach to the issue of regulating the supervision of the artificial intelligence market is characterized by the tendency to centralize supervision with specialized authorities, while allowing under certain conditions the designation of existing ones. In the financial sector, on the other hand, the European regulation considers the designation of the national authority responsible for financial supervision to be a natural purpose, except for derogation decisions supported by specific circumstances., After a quick look at foreign legal systems, the article focuses on the Italian legal system, which, with DDL no. 1146/ 2024 - unlike the European approach, prefers an absolute focus on AgID and ACN, without giving any specific importance to the national financial supervisory authority. This choice, notwithstanding the provisions of the AI Act, raises questions about the boundaries of competence and the need for a link to ensure consistent and effective supervision.
