Abstract
[Machine translation] The regulation of tariffs related to electricity and natural gas infrastructures represents one of the fundamental competencies of independent regulatory authorities in the energy sector. It is the subject of an articulated euro-unitary and national discipline, which has evolved significantly over the years, from the first liberalization regulations of the sector to the most recent directives, regulations and national standards, and has given rise to a very rich administrative case law. In this context, the question of the nature of the power exercised by independent regulators in the tariff sphere has taken on particular importance: that is, it involves only or mainly evaluations and technical choices or even properly political-discretionary assessments. On this issue, the present study intends to offer some systematic reflections, starting from the consideration of the basic characteristics of independent regulation and then analytically considering also the provisions dictated in this regard by the European and national regulations.
