Abstract
[Machine translation] Despite the rather sober title (“Provisions on metropolitan cities, provinces, unions and mergers of municipalities”), law no. 56 of 2014, known as the “Delrio law” (named after the proposing minister at the time of the filing of Legislative Decree C.1542), can be considered in many ways a “great system reform”, recalling - without any attached value judgment It has been used by the doctrine closest to the reforming spirit than the soul. More than a year after its enactment and in view of the expiry of the most important deadlines that it itself established for its implementation, it is possible to draw up a first assessment of its results. As with all major reforms - even in a technical-legal sense when it, with regard to the establishment of metropolitan cities, qualifies itself as such with respect to some regions with special autonomy - the basic issue concerns the actual change that the Delrio law has promised and is producing with respect to the previous discipline of the intermediate authority and the local system as a whole. Here, the issue will be addressed with reference to the reorganization of provincial functions, which constitutes one of the two pillars of the reform and will be discussed below considering: the provisions of the law that deal with it; the main implementing measures consisting of the agreement concluded at the State-Regions Conference on September 11 and the decree of the President of the Council of Ministers of September 26, 2014; the bills and the laws of reorganization of provincial functions under examination or already approved at the time in to which this text is dismissed (June 2015), whose review makes it possible to formulate some first evaluations on the general trend of the reform process.
