Abstract
[Machine translation] The principle of legal appearance was created by the judge and not by the legislator. The German and French-Italian legislators make a clear choice: the first in favor of external, manifested facts and the second in favor of the unformalized will. But in both cases, the legislator's clear choice generates interesting, very curious forms of counterlaw, which are nothing more than concessions to the opposite principle.
