Abstract
[Machine translation] The principle of legal appearance was created by the judge and not by the legislator. The study consists of two parts. The first aims to reconstruct the path followed by the principle under consideration in the French, German and Italian legal systems, finally taking a quick look at the Common Law system. The subject of investigation is identified, beyond the terminology used in each legal system, according to the interests that are at stake in cases governed by what in Italy is called the principle of legal appearance. The second part compares the data collected to propose a systematic reconstruction of the phenomenon.
