Abstract
[Machine translation] Many people call for the harmonization of European private law. It is known, however, that there are irreconcilable legal principles in Europe. In these cases, it is necessary to evaluate the extent to which the irreconcilability of the choices of principle produces differing results at the operational level, in which sectors this occurs and what are the consequences. One of the most significant examples is the contrast between the consensual principle adopted by the French civil code and the Abstraktionsprinzip established by the German civil code.
