Abstract
[Machine translation] The article proposes an annotation “at first reading” of the decision of the Constitutional Court n. 168 of 2021, concerning the Calabria Region's health recovery plan. The authors, criticizing some argument options adopted by the Court, focus in particular on three profiles of interest emerging from the reasons for the decision, which: a) constitutes a further stage in a particularly complex regulatory and institutional matter, such as that of the rehabilitation of the SSR, already affected in the past by numerous decisions of the Court and in recent years the subject of an ad hoc legislative discipline; b) it seems to be a prelude to development of a more rigorous and demanding union of constitutional legitimacy on legislation relating to return plans and to the contents of the acts themselves; c) offers a framework of the substitute powers of the State in the constitutional system and a vision of regional autonomy worthy of attention due to the novelty of some statements concerning the “potential value” of autonomy and the need for its “concrete proof”.
