Abstract

[Machine translation] This study aims to provide an analysis of the impact determined by the reform on the system for regulating preventive measures against corruption, both at the legislative and administrative levels, at a stage of their maturation. In particular, the first chapter analyzes the state of the art on risk planning and management six years after the issuance of the first law on the subject, together with the decision to centralize, in the hands of the person responsible for prevention and corruption, the responsibilities for the preparation and control of implementation measures. The decision to establish an authority with strengthened powers in the field of corruption (ANAC) will also be investigated, giving it wide margins of influence in the organizational activity of public administrations and regulation in the field of procurement. , The second chapter analyzes the evolution of the procurement discipline and the legislative choices aimed at reorganizing the matter as a whole, with the aim of preventing the corruption phenomenon in one of the sectors most exposed and at risk. In the third chapter, the issue of the legal value of the guidelines issued is explored: in particular, the reasons, and the consequences, placed at the basis of the legislator's choice to assign new powers to this authority, which is not limited only to providing suggestions as indicators of good practice, but adopts acts with a para-regulatory value. Recording in this choice a further confirmation of the phenomenon already described in the past as an escape from regulation, we will focus on the location of acts of flexible regulation in the system of sources of law. Further study, in the last final chapter, is dedicated to the role of the authorities traditionally placed to oversee the system of legality in public administrations, with functions mainly suppressing corruption practices: in the present study, we will analyze additional areas of intervention of the accounting and administrative judiciary, also highlighting the increasingly marked synergies between the distinct roles and law enforcement actions of the judiciary of the Court of Auditors, the Administrative Judge and ANAC, in particular in the field of procurement.
