Abstract
[Machine translation] The chapter deals with defining a new evidentiary category, the 'automatically generated' test, to indicate the cognitive elements potentially useful to the criminal process, because they can be traced back to art. 187 of the Italian Civil Code, which are however generated automatically. The need to establish their aptitude and probative capacity represents an essential step for their eligibility in the trial, under penalty of violating the fundamental guarantee of equal arms and the right to proof to the contrary.
