Abstract

The volume answers the question through a journey that reconstructs the genealogy of the notion of religious minority in the prism of its legal definition, its genesis in the law of the League of Nations, its development by the United Nations and its circulation in the Council of Europe, the European Union and the Organization for Security and Cooperation in Europe. The three phases — genesis, development, circulation — mark the transformation of a concept that, without an official legal definition, becomes, starting after World War II, a category increasingly exposed to the transformations affecting religious minorities. In this light, the legal qualification of the status of religious minorities also represents an innovative tool for investigating broader phenomena such as the overlaps between religions and migrations, the intersection between religious identity, gender identity and sexual orientation, and the synergies between international institutions in the protection of human rights.
