Abstract

[Machine translation] Starting from three recent legitimacy rulings that have intervened to clarify the notion of “terms of use” (used by art. 67, paragraph 3, letter a, bankruptcy law and verbatim taken up by legislative decree no. 14 / 2019), the article briefly reconstructs the current situation and then proposes some reflections in consideration of the new socio-economic context we are experiencing and the debate currently underway regarding the renegotiation of the contract.
