Abstract

[Machine translation] The consumer's right to repay the loan early and to reduce the total cost of credit has given rise to no secondary interpretative doubts. Starting from the interpretation provided by the Court of Justice in the so-called Lexitor ruling and considering the recent ruling of the Constitutional Court of December 22, 2022, which declared the constitutional illegitimacy of art. 11-octies, paragraph 2, so-called Sostegni-bis decree, the article attempts to identify the discipline applicable to the return of undue costs in relation to the remaining duration of the loan, making specific reference to the rules on undue debt and unjust enrichment.
