Abstract

[Machine translation] Legislative Decree no. 14/2019, in implementation of art. 8 of delegated law no. 155/2017, provided for an expansion of debt, consistent with the philosophy of the entire reform and with international comparison, from which it emerges that in recent years the institution has assumed increasing importance (attested to the particular attention given to it by Recommendation 2014/135/EU and EU Directive n. 1023/2019). , The purpose of the chapter is to highlight the physiognomy of the institution, the elements of novelty (on a subjective and objective, substantive and procedural level) of the discipline and the systematic repercussions.
