Abstract

This paper faces the question of the new self-defense law in the new fourth paragraph of art. 52 italian Criminal Code introduced by the law 26 April 2019, nr. 36. The new law reform presents some critical profiles with regard to the nature of the new justification (home self-defense) and which reflect a reform that is at the same time contradictory and created systematic imbalances. This contribution defends the position that the "proportion" requirement should be jettisoned. What matters is that it was necessary to use self-defensive force against an aggressor but in fact disproportionate. Necessity is important evidentially: it helps us answer the question of imminence and after all the proportionality. Those last requirement should be replaced with a necessity requirement, probably with the stipulation of a rebuttable presumption that the proportion requirement is not met if the danger was not imminent and the reaction not necessary.
