Abstract

[Machine translation] The work analyzes the impact of digitalization on the Public Administration, focusing, in particular, on the relationship between the exercise of functions, administrative and open data (Open Data). Reconstructing the legal concept of digitizing the Public Administration, it emerges that digitalization can be understood as an executive and organizational process that consists of two moments. On the one hand, the Public Administration acts,, and it is organized to act, to exercise pre-existing administrative functions with digital technologies (ICT), in order to implement “traditional” principles, of the Administration (e.g. impartiality, good performance, effectiveness, efficiency, cost-effectiveness). In this way, the Public Administration, thanks to technology,, He finds himself performing more efficiently administrative functions that he has always performed: he finds himself exercising what may be, defined as 'digitized administrative functions'. On the other hand, the Administration acts, and organizes itself to act, to exercise new, non-existing administrative functions with ICTs, in order to implement the principles of the Open Government strategy (transparency, participation and collaboration)., In doing so, the Administration finds itself exercising innovative, new administrative functions, made concrete possible by the use of technology, digital: what can be defined as “native digital administrative functions”, an example of which can be represented by Open Data Analysis, publish.
