Abstract
[Machine translation] The paper examines the dynamics of consent in the digital context, in particular with regard to relationships with digital platforms. After defining the notion of digital platform that can be derived from the relevant legislation, the paper clarifies that digital platforms cannot be understood as brokerage firms and must instead be considered as production companies. Therefore, focusing attention on the contractual relationships that users establish with digital platforms, we critically consider those doctrinal settings that in this context devalue the role of consent and agreement, affirming the need to decline the relationship that is established with the digital platform in properly contractual terms.
