Abstract

[Machine translation] Comment on the decision 15824/2014 of the Court of Cassation. The ruling excludes compensation in favor of a food producer who has purchased and used an ingredient containing a toxic contaminant, as food safety rules impose a duty of mutual surveillance that causes an interruption of the causal link pursuant to art. 1227 of the Italian Civil Code. The A. highlights the possible impacts of such an approach in relation to the characteristics of the food chain, exposed to high risk and with small operators.
