Abstract

[Machine translation] In arbitration, respect for the adversarial principle must be guaranteed even with respect to the totally inactive party (essentially similar to the contumacious party in the ordinary cognition process); there is no rule that governs the point and therefore the comment deals with the problem if it is applicable, at least by analogy, art. 292 of the Italian Civil Code dictated for the ordinary judgment of cognition and if it is necessary to provide, due to the peculiarity of the arbitration, the adoption of more extensive precautions.
