Abstract

[Machine translation] The monograph is dedicated to the reconstruction of Roman jurisprudential reflection on the subject of the alienation of the property subject to a legacy. The numerous studies dedicated to the subject, especially in the first half of the last century, were mostly characterized by a mechanical application of the interpolationist method and by rigidly predetermined historical contrasts; in the present research, based on a more conservative exegetical approach to the texts examined, it has instead come to light how the conflicted affirmation of the typical interpretation of alienation as a revocation, has left some classical jurists a wide margin for researching and evaluating the will individual emerging from concrete cases, with varied solutions that smoothed out the rigidity of typical interpretation, solutions that the post-classical and Justinian tendency to enhance individual interpretation have then translated into general principles.
