Abstract
[Machine translation] The essay presents a critical analysis of the role of social networks as a communication tool in the context of public administration and, more specifically, by holders of institutional offices. In the first part, it focuses on the legal framework of social networks both in reference to the discipline of the Code of Digital Administration, and in the context of the legislation that regulates communication and public information. In the second part, the article analyzes in a comparative way a series of issues that have recently emerged in jurisprudence related to the use of social networks as a communication channel by holders of institutional offices. In conclusion, this contribution highlights a growing discrepancy between current legislation and social reality, underlining the adjustment role played so far by jurisprudence and encouraging the introduction of technologically neutral and flexible legislation, which can offer appropriate guarantees for the use of social networks in the institutional context.
